Art. 1 Parties

Supplier: the company Casa Capone Jewelry, Via del Ponte 1, 56010 Caprona-Pisa-, Tax Code and VAT No. 01001430501 (hereinafter referred to as Supplier).

Customer: the party identified by the data entered at the time of registration and acceptance of these general conditions (hereinafter referred to as Customer).

Art. 2 Subject of the Service

Through the e-commerce service, the Supplier makes available to the Customer a virtual shop from which it is possible to view and purchase products from the Supplier itself. The Customer will be able to view the electronic catalogue and the Supplier's offers and make purchases from the Supplier according to these terms and conditions of sale.

Art. 3 Acceptance of General Terms and Conditions of Sale

The customer can only purchase products that are available on the Site from time to time at the time of access by the customer, according to the quantities indicated therein. To make a purchase, the customer, by accessing the Site, must first register and then formulate an appropriate order, following the instructions and IT procedures present therein.

At the time of purchase, the customer must provide, as mandatory, a valid and regularly active personal email address. The general terms and conditions of sale may be updated or modified at any time by www.caponeshop.com, which will notify this through the website pages. The Customer, by electronically sending confirmation of their purchase order, unconditionally accepts and undertakes to observe, in their relations with www.caponeshop.com, the general terms and conditions of sale, including the payment conditions illustrated below, declaring to have read and accepting all the information provided.

Art. 4 Prices and Guarantee

All selling prices of marketed products are displayed and indicated on the website www.caponeshop.com, and they constitute an offer to the public pursuant to Art. 1336 of the Italian Civil Code. Unless otherwise indicated in writing, all prices shown are to be understood as "VAT included" and expressed in Euros. Shipping costs are excluded from the price of the item and, indicated separately, are to be borne by the Customer. The validity of the indicated prices is always and only that indicated by the procedure at the very moment the order is submitted to the Supplier.

Products are delivered anywhere in Italy. Abroad, delivery is only made to the countries indicated in the appropriate list within the Site, where the transport, shipping and insurance costs that the customer must take care to verify before confirming their purchase are also indicated. All these costs are entirely borne by the customer, in addition to the selling price of the products. For delivery abroad, in countries where this is provided, additional transport, shipping and insurance costs are payable, always at the customer's expense, as indicated from time to time, in addition to taxes and/or duties provided for by the regulations of the transit and/or destination country(ies) applicable from time to time.

Art. 5 Customer Obligations

The Customer is strictly prohibited from entering false, invented, or fictitious data in the registration procedure necessary to activate the process for the execution of this contract and related further communications; the personal data and email must be exclusively their own real personal data and not those of third parties, or fictitious.

It is expressly forbidden to enter data of third parties. The Supplier reserves the right to legally pursue any violation and abuse, in the interest and protection of all consumers.

The Customer indemnifies the Supplier from any liability arising from the issuance of incorrect tax documents due to errors relating to the data provided by the customer, being themselves solely responsible for their correct entry. In case of failure to collect the goods by the customer, the shipping costs and any charges incurred will be borne by the customer, therefore deducted from the amount that will be refunded.

Art. 6 Delivery Methods and Times

Caponeshop.com will deliver the requested product to the customer through couriers and/or shippers of their trust. In case of absence of the customer/recipient at the time of delivery, it will be possible to arrange a new delivery. Upon receipt of the goods at their home, the Customer must verify the integrity of the package and the quantitative and qualitative correspondence with what is indicated in the accompanying document.

Except in cases of force majeure, delivery to the customer of the purchased product takes place indicatively within 7 (seven) working days from the order or, in any case, within the final term of 30 (thirty) days from the order.

No liability can be attributed to www.caponeshop.com for delayed or failed delivery attributable to causes of force majeure or fortuitous events.

Art. 7 Right of Withdrawal

Pursuant to Article 64 of Legislative Decree No. 205/06, the customer may exercise the right of withdrawal and return the product received, in compliance with the terms and conditions indicated below.

The customer will be entitled to a refund of the price, shipping costs and return costs, for the return of defective products or delivered products that do not correspond to the order placed by the customer or in case of damage to them due to transport or shipping errors by Capone Shop. It is possible to make a return for any reason within 10 days from the moment delivery was made. You can request a return in two ways: via email at info@caponeshop.com or by contacting us via WhatsApp at +39 3468497240. Once the return has been requested, it is necessary that the item be placed back in the same packaging complete with all attached materials. We will send the waybill by email which the customer must print and attach to the package. It will always be our care to arrange collection by the courier.

The refund will be made following receipt of the shipment with the returned products. If the return does not meet the conditions listed, the refund will not be made. Once the conditions of the goods have been ascertained, the refund will be made within thirty (30) working days using the same payment method used by the customer to purchase: any customs duties for the return to Italy will be deducted from the value of the returned purchase. It should be noted that the integrity of the product to be returned is an essential condition for exercising the right of withdrawal and that Capone Shop will carry out the necessary checks upon return. The product must be returned together with its original packaging, relevant documentation, and any additional components, without exception.

Art. 8 Validity of Communications

The Supplier is not responsible for any fraudulent and illicit use that may be made by third parties of credit cards or other means of payment, at the time of payment for purchased products. The Supplier at no time during the purchase procedure is able to know the Customer's credit card data, which they will transmit directly to the payment service manager without intermediaries and to which they will be automatically connected, returning to the Supplier's site at the end of the procedure.

For all online services on the site, the connection costs charged by the Provider used by the Customer for the connection itself apply, to which the Customer must refer to obtain the necessary information.

Art. 9 Jurisdiction and Competent Court

These general terms and conditions of sale are governed by the laws of the Italian Republic. For any dispute, the Italian Judicial Authority is competent.

Except as may be provided by mandatory provisions of law, the Court of Pisa shall have exclusive jurisdiction.

Art. 10 Intellectual Property

All elements of the Site, whether or not subject to the registration of an intellectual property right (photos, product sheets, descriptions, layouts) are the exclusive property of Casa Capone Jewelry SRL and cannot be used. All designs, models, brands, texts, visual or sound, comments, works, illustrations, images, reproduced on the Site www.caponeshop.com are protected by copyright, trademark rights and image rights and by any other applicable intellectual property right. They are the total property of Casa Capone Jewelry SRL or its partners. Any type of reproduction or representation, subject to counterfeiting may result in the civil and criminal liability of its author. Links referring to the Site www.caponeshop.com that use "framing" or "in-line linking" techniques are formally prohibited. In any case, any link or other content mentioned above, even if tacitly authorized, must be withdrawn immediately and upon simple request of Casa Capone Jewelry SRL, under penalty of legal consequences.
