This website (the “Site”) is the exclusive property of Casa Capone Jewelry SRL, via Del Ponte 1 Caprona (I), Italy. The use of the Site constitutes implicit acceptance of the terms and conditions set out below.

Art. 1 Subjects – Supplier: the company Casa Capone Jewelry, Via delPonte 1, 56010 Caprona-Pisa-, C.F. and P.I. 01001430501 (hereinafter referred to as Supplier).
Customer: the subject identified by the data entered at the time of registration and acceptance of these general conditions (hereinafter referred to as the Customer).

Art. 2 Object of the service – Through the e-commerce service, the Supplier makes available to the Customer a virtual store from which it is possible to view and purchase products from the Supplier. The Customer may view the electronic catalog and the Offers of the Supplier and make purchases from the Supplier according to these conditions of sale.

Art. 3 Acceptance of the general conditions of sale – The customer can only purchase the products that are available from time to time on the Site at the time of access by the customer, according to the quantities indicated therein. To make a purchase, the customer, by accessing the Site, must first register and then formulate a special order, following the instructions and IT procedures present therein.
At the time of purchase, the customer must provide, mandatorily, a personal, valid and regularly active e-mail address. The general conditions of sale may be updated or modified at any time by www.caponeshop.com who will communicate them through the pages of the website. The Customer, by sending the confirmation of his purchase order electronically, unconditionally accepts and undertakes to observe, in his relations with www.caponeshop.com, the general conditions of sale, including the payment conditions illustrated below, declaring to have read and accepting all the indications provided.

Art. 4 Prices and warranty – All sales prices of the products marketed are displayed and indicated on the website www.caponeshop.com, the same constitute an offer to the public pursuant to art. 1336 c.c.. Unless otherwise indicated in writing, all prices indicated are to be understood as “VAT included” and expressed in Euros. Shipping costs are excluded from the price of the object and, indicated separately, are charged to the Customer. The validity of the prices indicated is always and only that indicated by the procedure at the time of forwarding the order to the Supplier.
We deliver the products anywhere in Italy. Abroad, delivery is made only in the countries indicated in the appropriate list on the Site, where the transport, shipping and insurance costs are also indicated, which the customer must take care to verify before confirming his purchase. All these costs are fully borne by the customer, in addition to the selling price of the products. For delivery abroad, in countries where this is provided, the additional costs of transport, shipping and insurance indicated from time to time are due, always at the expense of the customer, in addition to the taxes and / or fees provided for by the legislation of the country ( s) of transit and / or destination from time to time applicable.

Art. 5 Obligations of the Customer – It is strictly forbidden for the Customer to enter false and/or invented and/or fictitious data in the registration procedure necessary to activate the procedure for the execution of this contract and the related further communications; the personal data and the e-mail must be exclusively your real personal data and not of third parties, or fantasy.
It is expressly forbidden to enter data of third parties. The Supplier reserves the right to prosecute any violation and abuse, in the interest and for the protection of all consumers.
The Customer indemnifies the Supplier from any liability deriving from the issuance of incorrect tax documents due to errors in the data provided by the customer, being himself solely responsible for the correct insertion. In case of non-collection of the goods by the customer, the shipping costs and any charges incurred will be borne by the customer, therefore deducted from the amount that will be reimbursed.

Art.6 Delivery methods and times – Caponeshop.com will deliver the requested product to the customer, through couriers and / or shippers of their trust. In case of absence of the customer / recipient at the time of delivery, it will be possible to agree on a new delivery. Upon receipt of the goods at home, the Customer must verify the integrity of the package and the quantitative and qualitative correspondence with what is indicated in the accompanying document.
Except in cases of force majeure, the delivery to the customer of the purchased product takes place approximately within 7 (seven) working days from the order or, in any case, within the deadline of 30 (thirty) days from the order.
No responsibility can be attributed to www.caponeshop.com for delayed or non-delivery due to force majeure or unforeseeable circumstances.

Art.7 Right of withdrawal – Pursuant to art. 64 of Legislative Decree no. 205/06 the customer can exercise the right of withdrawal and return the product received, in compliance with the terms and conditions indicated below.
The customer will be entitled to a refund of the price, shipping costs and return costs, for the return of defective products or delivered products that do not correspond to the order placed by the customer himself or in case of damage to them due to transport or errors in shipping by Capone Shop. You can make the return for any reason within 10 days from the moment the delivery was made. You can request the return in two ways: by e-mail to the address [email protected] or by contacting us via Whatsapp at +39 3468497240. Once the return has been requested, it is necessary that the object is placed in the same package and complete with all the attached materials. We will send by e-mail the waybill that the customer must print and attach on the package. It will always be our concern to fix the collection by the courier. The refund will be made after receipt of the shipment with the returned products. If the return does not meet the conditions listed, the refund will not be made. Once the conditions of the goods have been ascertained, the refund will take place within thirty (30) working days through the same payment method used by the customer to purchase: from the value of the return purchase will be deducted any customs charges of return to Italy. It should be noted that the integrity of the product to be returned is an essential condition for the exercise of the right of withdrawal and that Capone Shop will comply with the necessary checks upon return. The product must be returned together with its original packaging, related documentation, and any additional components, without exception.

Art. 8 Validity of communications – The Supplier is not responsible for any fraudulent and illegal use that may be made by third parties of credit cards or other means of payment, at the time of payment of the products purchased. The Supplier at no time during the purchase procedure is able to know the data of the Customer’s credit card, which will transmit them directly to the payment service manager without intermediation and to which it will be connected automatically, returning to the Supplier’s site at the end of the procedure.
For all online services on the site, the connection costs charged by the Provider used by the Customer for the connection itself are applied, to which the Customer must contact to obtain the necessary information.

Art. 9 Jurisdiction and Competent Court – These general conditions of sale are governed by the laws of the Italian Republic. For any dispute, the Italian Judicial Authority is competent.
With the exception of any provisions of law, the Court of Pisa will have exclusive jurisdiction.

Art. 10 Intellectual Property – All elements of the Site subject or not of the registration of an intellectual property right (photos, product sheets, descriptions, layouts) are the exclusive property of Casa Capone Jewelry SRL and cannot be used. All designs, models, brands, texts, visual or sound, comments, works, illustrations, images, reproduced on the Site www.caponeshop.com are protected by copyright, trademark rights and image rights and by any other applicable intellectual property right. They are the total property of Casa Capone Jewelry SRL or its partners. Any type of reproduction or representation, object of counterfeiting can determine the onset of civil and criminal liability of its author. Links to the www.caponeshop.com Site using “framing” or “in-line linking” techniques are formally prohibited. In any case, any link or other content mentioned above, even if tacitly authorized, must be withdrawn immediately and at the simple request of the company Casa Capone Jewelry SRL, under penalty of the consequences of the law.
